Legal and Ethical Issues in the Psychotherapy Practice: From Recordkeeping to Keeping Boundaries

This presentation will cover topics pertaining to ethical and legal issues relating to mental health practices of psychologists and other mental health professionals. The focus will be on relevant practice issues and topics will include record keeping and what should be in the record, including treatment plans, proper diagnosing, progress notes, and psychotherapy notes; confidentiality and release of information, including responding to patient authorizations and subpoenas and HIPAA requirements; billing and billing improprieties, including significant billing issues with couple and family therapy; patient contact, including the use of texting and emails; the use and misuse of self-disclosure; boundaries, boundary crossings, and boundary violations; teletherapy and remote practice legal issues and clinical requirements; relevant practice documents, including informed consents, confidentiality notices, credit card authorization requirements; and No Surprises Act documents, and legal issues pertaining to legal matters, including testifying. The presentation will also include discussions of beginning a practice, employment and independent contractor issues, and winding down a practice, including the sale of a practice and professional wills. Emphasis throughout the presentation will be both on knowledge of relevant legal and ethical issues and practical strategies to avoid claims of unprofessional or negligent conduct.
